Social - Labor - Family Roots

Arraigo is one of the ways to obtain legal residence in Spain due to family, social or labor ties. Arraigo allows a foreigner who is living in Spain without having the corresponding residence permit to obtain legal residence due to the ties he/she has developed with the Spanish society. In literal terms, the foreigner has put down roots in Spain and, therefore, the immigration legislation allows him/her to reside legally in Spain due to his/her "integration". Rooting may be due to social, labor or family roots.

Arraigo social is a temporary residence authorization granted to a foreigner for his or her social integration in Spain. For this purpose, it is necessary to comply mainly with the following requirements (i) Have lived in Spain for a minimum of for a minimum period of three years (ii) To have family ties with other resident foreigners or submit a social integration report (iii) Have a signed employment contract between the foreigner (worker) and an employer.wich duration cannot be less than one year.

On the other hand, the "arraigo laboral" temporary residence authorization granted to a foreigner is a temporary residence authorization granted to a foreigner for having worked in Spain, albeit illegally. The foreigner must meet, mainly, the following requirements: (i) Have lived in Spain for a minimum of two (2) years continuously continuously (ii) Demonstrate that he/she has worked for at least six (6) monthsin Spain.

Finally, the "arraigo familiar" is a temporary residence authorization granted to foreign citizens in Spain who: (i) are the father or mother of a minor of Spanish natironality or (ii) are the children of a father or mother who were originally Spanish.

In all cases of "arraigo", the foreign citizen must not have a criminal record, i.e., it is necessary that he/she does not have a criminal record.
